Another Cavalier Followup

First of all, there was some sort of hearing at the Public Service Commission about the whole matter. You can read details in this article at the Maryland Record (I emailed the reporter asking if there was a transcript). Some of the more interesting parts:
- Four complaints were filed
- At least one person only had local service and was charged anyway
- The PSC feels that if every company can tack on federal tariffs there will be no point in having state laws
- Cavalier contents that the tariff in question is under federal purview
The last point is the most interesting. Cavalier has been contending the entire time both in this article and when replying to my original complaint, that this fee is imposed only on interstate service, thus taking it out of state jurisdiction. The interesting thing is that I also happened to file a complaint with the FCC as well about this – and guess what? They said it is not within federal jurisdiction and directed me to the PSC. Below I included all of the relevant documents including the FCC letter:
- “PSC challenges Cavalier’s monthly ‘energy fee’” by DANIELLE ULMAN; Maryland Daily Record; September 10th, 2008
- FCC Letter that this matter is under state jurisdiction (PDF)
- Copy of my reply to the FCC (PDF)
- Copy of my PSC followup reply to the PSC with the FCC letter included (PDF)
